Conditions of participation

Participation in the sweepstakes of

D&F Sweets GmbH, Hirzenrott 6, 52076 Aachen, Germany

hereinafter referred to as the organizer, is free of charge and is governed exclusively by these conditions of participation.

Eligible

Natural persons who have reached the age of 18 are eligible to participate. Participation is limited to recipients of the D&F newsletter and customers of D&F Sweets GmbH as well as visitors to the website.

Employees of the organizer and its affiliated companies and their family members are not eligible to participate in the sweepstakes. In addition, the organizer reserves the right, at its own discretion, to exclude persons from participation if there are justified reasons, for example

1. in case of manipulations in connection with the implementation of the lottery,
2. in the event of violations of these conditions of participation,
3. in the event of false or misleading information in connection with participation in the sweepstakes.

Participation

Participation in the competition takes place by sending the fully completed booking form. By sending the form, the participant accepts these conditions of participation. Participation is only possible until the closing date. Entries received after the closing date will not be considered in the draw.

The closing date for the competition is 23.12.2022, 23:59. The electronically recorded receipt of the survey form by the organizer serves to verify timely receipt.

Only one submitted registration per participant will be entered into the competition. It is prohibited to use multiple email addresses to increase the chances of winning.

Winning, notification and transmission of the prize

The following prizes will be awarded:

– 20% discount on one training
– 5 surprise packages
The winners will be determined after the closing date by a random draw among all participants.

The winner(s) of the raffle will be notified by the organizer by e-mail within one week after the closing date. In the event of an undeliverable notification, the Promoter is not obliged to make further inquiries and may determine a new winner. If the winner does not respond within one week after notification of the prize, the organizer is also entitled to determine a new winner.

The prize will be handed over exclusively to the winner. An exchange, a self-collection as well as a cash payment of the prize are not possible. Prizes in kind will be sent to the winner by mail to his home address, the shipping costs for this will be borne by the organizer. The winner is responsible for any taxation of the prize.

Termination of the competition

The organizer expressly reserves the right to interrupt or terminate the competition at any time without prior notice and without giving reasons and to adjust these conditions of participation.

Privacy

For the participation in the raffle the indication of the personal e-mail address is necessary. The participant assures that the personal data provided by him/her are true and correct. In the case of non-cash prizes, further personal data, such as the address, will be requested from the winners after the end of the competition as part of the notification of the prize. The collection and processing of personal data is solely for the purpose of conducting the competition and, if applicable, sending the prizes. All data will only be stored for the purpose and for the duration of the competition and will be deleted at the end of the campaign, unless there are legal obligations to retain data.

The personal data of the participants will neither be passed on to third parties nor given to them for use without their consent. An exception is the company D&F Sweets GmbH, Hirzenrott 6, 52076 Aachen, which is commissioned to carry out the competition, in particular to send the prize, and which collects, stores and uses the data for the purpose of carrying out the competition.

In case of winning, the winner agrees to the publication of his name in the advertising media used by the organizer. This includes the announcement of the winner on the website of the organizer and its social media platforms.

The participant may at any time obtain information about his data stored by the organizer, object to the use of his data and request its deletion. For this purpose, a simple letter to D&F Sweets GmbH, Hirzenrott 6, 52076 Aachen or an e-mail to info@df-sweets.de <mailto:info@df-sweets.de is sufficient.
After revocation of the consent, the collected and stored personal data of the participant will be deleted immediately.

Liability

The organizer is not liable for damages caused by errors, delays or interruptions in the transmission, in the event of malfunctions of the technical equipment and service, incorrect content, loss or deletion of data, viruses or in any other way during participation in the sweepstakes, unless such damages were caused by the organizer (its bodies, employees or vicarious agents) intentionally or through gross negligence. The above limitation of liability shall not apply in the event of injury to life, limb or health or in the event of fraudulently concealed defects.

Applicable law

The competition is governed exclusively by the laws of the Federal Republic of Germany. The legal process is excluded.

Severability clause

If any provision of these Terms and Conditions of Participation is or becomes invalid in whole or in part, this shall not affect the validity of the remaining provisions of these Terms and Conditions of Participation. In place of the invalid provision, the legally permissible provision that comes closest in economic terms to the meaning and purpose expressed in the invalid provision shall apply. The same shall apply in the event of a loophole in these Terms and Conditions of Participation.
